PLEASE NOTE THIS FORM DISCLOSES THE TRAVEL TERMS OF FunList.com LLC. This statement applies to you: (1) while using any World Wide Web Sites owned and maintained by FunList.com LLC; (2) while participating in events and trips produced or sponsored by FunList; and/or (3) for your purchase and/or use of any products and services offered by FunList and its commonly held affiliates.

Your use of the FunList Website and/or aforementioned events, trips, products and services constitutes your acceptance of the terms and conditions of the Terms of Use, Travel Terms, Release of Liability Waiver, Refund Policy, and our Privacy Policy. You are responsible for reviewing and becoming familiar with all of these terms.

Travel Terms

FunList and or their agents act only in the manner of providing services and cannot accept responsibility in whole or part for the following:

FunList shall be responsible to the passenger for supplying services and accommodations described in this “online” brochure, except where such services cannot be supplied or the itinerary used is changed due to delays or other causes of whatever kind or nature beyond the control of FunList, their operators or agents. In such circumstances the operators will do their best to supply comparable services, accommodations, and itineraries and there shall be no refund under this condition.

In the absence of their own negligence, neither the operators nor their agents, or co-operating organizations shall be responsible for any cancellations or for any acts of any other service provider, diversions or substitution of equipment of any act variations, postponements, omission or default whatsoever by any air carriers, land carriers, hoteliers, hotels, transportation companies, or any other persons providing services and accommodations to passengers including any results thereof, such as changes in services, accommodations, or facilities necessitated by the same. Nor shall they be liable for any loss or damage to baggage or property or for injuries, illness, or death or for any damages or claims whatsoever arising from loss, negligence, or delay from the act, error, omission, default or negligence of any country, government, governmental authority, officer or employee. All baggage and personal effects are at all times and in all circumstances at the risk of the tour participant. Baggage insurance is recommended. Upon return to the United States, if lost articles are found and returned to the owner, a minimum service fee of $50 will be charged. The carriers, hotels, and other suppliers who provide services on tour are independent contractors; they are not agents, employees, or servants of the operators or their associated companies. The operators are not responsible for any criminal conduct by third parties.

Where the passenger occupies a motor coach seat fitted with a safety belt, neither the Operators nor their agents or cooperating organizations or service providers concerned will be liable for any injury, illness, or death or for any loss or damages, or claims whatsoever arising from any accident or incident if the safety belt is not being worn at the time of such accident or incident.

Transportation companies, airlines, etc. are not to be held responsible for any act, omission, or event during the time passengers are not on board planes, transportation, or conveyances. The passenger contracts in use by the airlines or transportation companies when used shall constitute the sole contract between the airline, transportation company and passenger or purchaser of this tour, and the Operators assume no responsibility in this connection. Enrollment in and payment for a tour shall constitute agreement and acceptance by the passenger of the terms and conditions set forth in this “online” brochure which cannot be varied except in writing by an officer of the company.

Late changes: Changes made by a traveler after the deadline date affecting destination, departure date, passport names and/or traveler names are subject to a processing fee of $75 plus any cost incurred from our suppliers. Once the tour has departed, changes affecting return date or gateway will not be permitted.

It is the responsibility to comply with the terms, conditions, or requirements of any service provider, or any country or governmental authority, or to bear any costs or losses incurred as a consequence of you not complying with them.

Roommates: Please email reservations@funlist.com with the name of the person you wish to room with should you have a preference. If you wish to share a twin-occupancy room but don’t know another participant we will do our best to assign you a roommate. However, if this is not possible, you must be prepared to pay the single supplement. We cannot be responsible for compatibility, so we suggest that you talk on the phone before the trip to be certain that you will get along.

Tour Prices: All tour prices are based on rates (including foreign exchange rates) known at the time of trip posting and expected to be in effect at the time of departure. Prices are subject to increase without notice if such rates change prior to departure. The current trip price will be confirmed at the time of reservation. However, land costs are guaranteed when a trip deposit is received, not including surcharges and any government tax increases. Airfares included as part of air-inclusive tour are guaranteed when we receive full payment, but are subject to fluctuations in airfare taxes. Tour prices are per person, based on double occupancy. Single room supplements are listed where applicable.

Travel Documents: Travel documents including any airline tickets and instructions will be sent to you approximately 7 - 14 days prior to departure (providing full payment has been received). A $15 fee will be charged to provide travel documents earlier than 14 days prior to departure.

Making Your Own Flight Arrangements: If you wish to make any of your own flight arrangements, you may do so at your own risk. A “land-only” traveler is someone who arranges his or her own flights to the first city and from the last city of the tour. Land-only travelers are responsible for arranging their own airport transfers and flights between cities in the tour itinerary. If FunList or their representative is forced to change the travel program in any way, the traveler will be responsible for altering individual flight plans accordingly, and will be responsible for any costs that result from the changes.

Legal Responsibilities: Your payment of the required reservation deposit constitutes consent to all provisions of the conditions and general information contained herein. No warranties, representations, terms or conditions apply to any travel program unless expressly stated within these Terms & Conditions (or in a letter signed by a FunList or their representative officer). Each program begins with the takeoff from your chosen departure gateway, and ends upon completion of your return flight. (For those making their own flight arrangements, or requesting flight deviations: 1) the travel program begins upon arrival at the first FunList or their representative hotel and ends upon departure from the last FunList or their representative hotel according to the itinerary; 2) flights between cities during your tour are not an official part of the itinerary.) Any issues pertaining to the tour should be addressed first and foremost to the Tour Director while on tour.

FunList or their representative reserves the right to change or cancel any aspect of a program at any time without notice. FunList or their representative reserves the right to decline to accept or retain any person as a member of any tour without notice. FunList or their representative cannot be held responsible for events beyond its control, such as (without limitation) acts of God, war (whether declared or undeclared), terrorist activities, strikes or government restrictions; nor, in the absence of its own negligence, for personal injury, property damage, or loss of earnings, from any event whatsoever caused by persons not controlled by FunList or their representative, such as (without limitation) the employees of airlines, cruise lines, railways, bus companies and hotels. While we make every effort to ensure the accuracy of our publications, we cannot be held responsible for typographical or printing errors (including prices).

Itinerary Variations: If improvements can be made to programs, or unforeseen circumstances require us to make changes, we reserve the right to vary itineraries and to substitute hotels of equal or greater quality. FunList or their representative cannot control program changes on cruise tours, as cruise lines reserve the right to make program changes. FunList or their representative will make every effort to notify you as early as possible in the event of a change.

In the event of participant cancellation, payments received will be refunded subject to the following conditions:

Trip Deposit: A non-refundable deposit as detailed in the specific trip information per person and per tour is required to hold a seat(s) for you.

Refunds & Cancellations: Cancellations are very costly and usually do not occur in time for resale of the canceled tour. Should you cancel your reservation, the following fees will be charged. If you have purchased Cancellation/Interruption Insurance, these cancellation fees may be refunded by the insurance company after your claim has been approved.

Airline tickets are subject to the refund or revision policies of the air carrier. FunList cannot assume responsibility for any additional costs/fees relating to the issuance and/or cancellation of air tickets or other travel arrangements not made through FunList.

FunList or their representative reserve the right to reschedule or cancel a tour with fewer than 12 travelers. FunList Cancellation: FULL refund of all payment(s) should FunList cancel a trip.

Cancellation of Tours:

Cancelation, Prior to Departure & Fee for Cancellation:
130 days or more, before departure – 100% of Trip Cost Refunded
75-129 days before departure – 65% of Trip Cost Refunded
41-74 days before departure – 50% of Trip Cost Refunded
0-40 days before departure – No Refund
Day of departure – No Refund
Airline tickets are non-refundable

Cancellation Insurance: cancellation insurance is available and a detailed brochure will be sent to all participants who request this information. Please send requests to info@funlist.com.

Passport: a valid US passport is required to travel to most countries outside of the USA, including Canada. It must be valid at the time of departure and return from/to the USA. Please note that if you need a new passport or need to renew one, processing time can take up to 4-6 weeks. If you are not a US citizen a visa may be required. Please email info@funlist.com for specific information regarding visas.

FunList reserves the right to increase published trip, cruise rates and air fare supplements without prior notice when necessary because of vendor increases.

FunList reserves the right to modify or cancel travel trips due to vendor, outfitter, or supplier changes/cancellations, or weather conditions out of our control.

While it is typical that adventure trips, historic and cultural tours, and cruises solicit registrations from both men and women, due to the complexity of the planning, administration, and nature of trip participant cancellations of these trips and cruises, FunList cannot gender balance, and gender ratios may change at any time prior to the trip departure.

CHANGE POLICY

From time to time we may revise these Travel Terms. If we make a material change, we will post a notice on the FunList Website or notify you by e-mail.

By using FunList Websites, participating in FunList events and trips, and/or purchasing FunList products and services, you assent to the FunList Travel Terms. If you do not agree to these terms, please do not use this Website, participate in FunList events and trips, and/or buy FunList products and services.
